    Out of Use in the water – clarification from the CA

    This is potentially confusing in the use of the word OUT OF USE. To port police, this is DEKPA talk – to put a vessel Out of Use when hauled out ONLY.

    For the sake of clarity you must make your request to “Apply for exemption from the E-TEPAI. ”

    Through the site aade.gr we tried to fill in the application form we double checked every question but the final submission fails , and we got the error message : unexpected Application error !
    Who knows the solution To solve this problem ?

      I have exactly the same issue… I always get “unexpected error”. It does not list the problem. The application stays “Temporarily Stored” …
      Any help is welcome

      Same for me – last step unexpected error. It looks it is a problem on their side with connection to the database. It is persisting for 3 days for me now. I was trying to search for some technical contact or something but did not find any. Is there somebody who successfully went thru recently?

      Any other suggestions?

      Same for me. last step unexpected error. tried twice deleting the form and starting again – no luck. Any way of contacting the web people?

    Jan Leonard: If you stay in Preveza, you are most likely on the hard? Any boat out of the water is not subject to the TEPAI according to the broschure and the FAQ issued by the Greek Tax authoriy.

    Ships exempt from TEPAI, section three: Ships within the Greek territory but off-water, e.g. at a ship parking lot or in private premises, are not liable to pay TEPAI as not being in Greek territorial waters. (However, as soon as they enter such waters, TEPAI is immediately due)

    Also according to the FAQ section 2.17, issued by the tax department (https://www.aade.gr/dl_assets/etepai/etepai_faqs_en.pdf):

    Question: My ship is at a ship parking lot, or at my private premises (e.g. in the garden of my summer house). Is TEPAI due for that ship?

    Answer: The TEPAI is due for all ships IN Greek territorial WATERS, as detailed in questions 2.3. and 2.5.; therefore, any ship not in Greek territorial waters is not subject to TEPAI. It goes without saying that, as soon as the ship is in Greek territorial waters, the TEPAI shall be immediately due, as per the relevant provisions, unless exempt. For exemptions, see question 2.4.

    It’s unlikely the authorities will be chasing down boat owners, check each end every boat in the water, not going to happen. Paying the tax when you arrive before you renew your DEKPA should be good enough.

    According to the FAQ
    2.16.

    Q: In case I missed the payment of the TEPAI for a certain period in the past, may I still willingly pay the amount due, without fine?
    A: Yes. If you willingly pay the TEPAI for that previous period, no fine shall be imposed (e.g. you may pay the TEPAI for June 2019 in August 2019). However, if non-payment of the TEPAI is determined during an audit by a competent Authority, you shall be sanctioned accordingly.

    I have just been in touch with an agent in Preveza re declaring the boat out of use. They sent me a form to complete – the form is simple but needs to be notarised which is an extra £100 on top of agents fees of 75 Euros so this whole thing is becoming increasingly expensive. However, one interesting point is that there is no deadline date for getting your boat declared as Out of Use apparently and the agent suggested I go back to them at the end of April when they will know more. So confusing. We have sailed in Greece for over 13 years but now thinking it’s time to move…

    Our boat is in Gouvia marina Corfu. We will not be in Greece until May 31st. A friend who lives in Corfu took the ships papers plus a letter of authorisation from me translated to Greek to the Port Police to lodge so as to claim out of use until May 31. Port Police refused to accept saying they had no knowledge of the matter. we then had an email from Gouvia marina suggesting that the marina manager might be able to act on our behalf. Contacted the manager who said our Corfu friend should come to see him in his office. He did this today to be told that it was uncertain what was happening but we should arrange for our friend to be given a Power of Attorney. Now not possible before April 2nd!I am anxious to avoid a 1000 eur fine. Any suggestions?
